This Policy must be read alongside the Terms and Conditions, Privacy Policy, and Cookie Policy. Where there is a conflict between this Policy and the Terms and Conditions, the Terms and Conditions shall prevail.
2. Lawful Use Only
You may use the Services only for lawful purposes and in accordance with these Terms and Conditions, this Policy, applicable local, national, and international laws, and payment card and anti-fraud requirements where relevant. You must not use the Services in any way that could damage Nagram, other users, suppliers, or third parties.
In particular, you must not use the Services in a manner that: (i) facilitates a breach of the Consumer Rights Act 2015, the Fraud Act 2006, the Computer Misuse Act 1990, the Communications Act 2003, the UK GDPR, or any other applicable UK or international law; or (ii) would constitute an offence in your jurisdiction of residence or in England and Wales.
3. Prohibited Activities
You must not engage in any of the following conduct.
3.1 Fraudulent or Deceptive Activity
You must not: use stolen, unauthorised, or fraudulent payment methods; provide false identity or registration information; impersonate another person or entity; create fake accounts; evade subscription charges; abuse chargeback systems; attempt to obtain services without payment.
Fraudulent use of payment methods may constitute an offence under the Fraud Act 2006 (sections 1–3). Chargeback abuse and payment fraud may also give rise to civil claims and may be referred to Action Fraud and relevant card scheme fraud investigators.
3.2 Illegal Conduct
You must not use the Services to: commit or facilitate criminal offences; violate sanctions or export control laws; infringe consumer protection laws; distribute unlawful content; promote illegal gambling where prohibited; engage in money laundering or fraudulent schemes.
Use of the Services in connection with money laundering may constitute an offence under the Proceeds of Crime Act 2002 (POCA). Use in connection with terrorist financing may constitute an offence under the Terrorism Act 2000 and Terrorism Act 2006. We will report suspected relevant offences to the National Crime Agency (NCA) and, where appropriate, will make a Suspicious Activity Report (SAR) under POCA 2002.
3.3 Abuse of Accounts
You must not: share credentials in a prohibited manner; sell or transfer accounts without permission; access another user’s account; circumvent account suspensions; create multiple accounts for abuse or manipulation.
3.4 Interference with Services
You must not: disrupt servers or networks; overload systems; interfere with service functionality; bypass usage limits; manipulate platform metrics; interfere with payment flows or subscription systems.
Unauthorised interference with computer systems, data, or services may constitute an offence under the Computer Misuse Act 1990 (sections 1, 2, and 3). We will preserve evidence of such activity and cooperate with law enforcement.
4. Security Restrictions
You must not attempt to compromise the security of the Website or Services. Prohibited actions include hacking attempts, credential stuffing, brute-force login attempts, vulnerability exploitation, phishing, malware deployment, spyware, ransomware, trojans, or harmful code, probing systems without authorisation, and reverse engineering security controls.
Unauthorised access to or interference with computer systems or data is a criminal offence under the Computer Misuse Act 1990. Serious incidents will be reported to the National Cyber Security Centre (NCSC) and, where appropriate, to the relevant law enforcement authority. We may report serious incidents to relevant authorities.
5. Intellectual Property Protection
All content made available through Nagram remains owned by Nagram or its licensors. You must not, except where expressly permitted:
- copy content;
- record streams;
- download protected materials;
- redistribute materials;
- mirror the Website;
- scrape content libraries;
- create derivative commercial products;
- resell subscriptions;
- remove copyright or branding notices.
Infringement of copyright in digital content may give rise to civil claims under the Copyright, Designs and Patents Act 1988 (CDPA). Where streaming or broadcast rights are involved, unauthorised retransmission or communication to the public may also constitute an infringement under CDPA section 20.
6. Automated Access and Scraping
You must not use bots, crawlers, scripts, scraping tools, or automated systems to access the Services in a way that places unreasonable load on systems, extracts content or data at scale, circumvents subscriptions or paywalls, imitates genuine user activity, or manipulates rankings or engagement metrics. Reasonable search engine indexing may be permitted where authorised.
Systematic extraction of substantial parts of any database accessible through the Services may infringe database rights protected by the Copyright and Rights in Databases Regulations 1997 (implementing Directive 96/9/EC as retained in UK law). Such extraction may give rise to civil claims for injunctive relief and damages.
7. User Communications and Conduct
If the Services permit reviews, comments, support messages, or other communication features, you must not submit content that is abusive, threatening, hateful, discriminatory, obscene, defamatory, misleading, fraudulent, spam, or infringing third-party rights. Users must behave respectfully when dealing with support staff and other users.
Defamatory communications may give rise to claims under the Defamation Act 2013. Hateful or threatening communications directed at individuals may constitute offences under the Communications Act 2003 or the Public Order Act 1986. We will cooperate with law enforcement where required and may disclose user information in response to a lawful request.
8. Health, Fitness and Sports Use
Where content includes fitness, health, sport, or training material, you must use such material responsibly. You must not misuse instructional content in dangerous ways, rely on content as medical advice, or encourage unsafe conduct through platform interactions. Participation in exercise or sport remains at the user’s own risk. This clause does not exclude any liability that cannot lawfully be excluded under the Consumer Rights Act 2015 or the Unfair Contract Terms Act 1977, including liability for death or personal injury caused by negligence.
9. Payment and Subscription Abuse
You must not: repeatedly subscribe and cancel to exploit promotions; use multiple identities to obtain duplicate offers; intentionally trigger failed payments; misuse trial periods; submit false refund claims; abuse merchant dispute processes. We may suspend accounts linked to such activity.
Abuse of refund, chargeback, or dispute processes may constitute fraud under the Fraud Act 2006. We may share relevant data with payment processors and card schemes for fraud prevention purposes, in accordance with our Privacy Policy.
10. Territorial and Licensing Restrictions
Certain content may be restricted by territory, licensing rights, or legal requirements. You must not bypass geo-restrictions unlawfully, use VPNs or technical tools to evade licensing controls where prohibited, or redistribute content into restricted markets. Evading territorial licensing controls may constitute a breach of the licensing agreements under which content is made available and may infringe the rights of third-party rights holders under the CDPA 1988 and applicable broadcasting and content licensing regulations.
11. Privacy and Data Misuse
You must not misuse any personal data obtained through the Services. Prohibited conduct includes harvesting email addresses, collecting personal data without permission, doxxing, identity theft, unauthorised marketing, and sharing private information of others.
Processing personal data obtained through the Services for purposes incompatible with those disclosed in our Privacy Policy constitutes a breach of UK GDPR Article 5(1)(b) (purpose limitation) and may give rise to liability under the Data Protection Act 2018. Identity theft and doxxing may also constitute criminal offences under the Identity Documents Act 2010 and the Malicious Communications Act 1988.
12. Monitoring and Enforcement
To protect the platform, Nagram may monitor usage patterns, payment risks, abuse indicators, and security events where lawful. All monitoring activity is carried out in accordance with UK GDPR, the Data Protection Act 2018, and PECR. Monitoring of user activity is limited to what is necessary and proportionate for the purposes of security, fraud prevention, and legal compliance.
If we reasonably believe this Policy has been breached, we may take action including: warnings; content removal; transaction cancellation; suspension of access; account termination; payment restrictions; legal action; regulatory reporting. Consumer rights under the Consumer Rights Act 2015 are not affected by any enforcement action taken under this Policy. Where we take action that affects your access to paid Services, we will notify you in accordance with the Terms and Conditions.
13. Reporting Violations
If you become aware of misuse of the Services, please contact: info@nagram.net. Please include sufficient detail for investigation.
Reports of suspected financial crime may also be directed to Action Fraud (www.actionfraud.police.uk) or the National Crime Agency (www.nationalcrimeagency.gov.uk). Reports of cybercrime may also be directed to the National Cyber Security Centre (www.ncsc.gov.uk).
14. No Right to Continued Access for Misuse
Users who breach this Policy may lose access to services, subscriptions, or promotional benefits without entitlement to compensation, subject to applicable law. This provision does not affect your statutory rights under the Consumer Rights Act 2015 or your right to a remedy in respect of Services that are faulty, not as described, or do not perform with reasonable care and skill.
15. Changes to this Policy
We may amend this Policy from time to time to reflect legal requirements, security risks, operational changes, new services, and fraud trends. Material amendments will be notified to registered users by prominent notice on the Website no less than 30 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the amended Policy.
